Family Mediation
Family Mediation is a solution based process where two or more willing people make important family decisions together to resolve a conflict and reach a mutually acceptable agreement with the assistance of a neutral third party mediator.
A mediator maintains impartiality and facilitates constructive communication to allow the parties the liberty to enter into an agreement without providing legal advice.
Mediation: ($225 hr. + tax & disbursements)

Pre-mediation
-
Meeting with each party privately to determine appropriateness of mediation, screen for family violence as required, s.8(1) of the Family Law Act;

Discuss confidentiality and review the Agreement to Mediate;

Gather information, build understanding, clarify interests;
-
Virtual Mediation is optional, Shuttle Mediation is preferred.

Mediation Session
-
Start time 9:30am or 10am.
-
Develop negotiations and collaboration by identifying common goals.
-
Distinguish resolvable issues by facilitating an interest based approach.
-
Identify and develop objective criteria such as appraisals, s.211 report or financial documents as a basis for settlement

Agreements
-
Minutes of Settlement or Memorandum of Understanding are non-binding agreements that can be prepared and signed the day of Mediation by consent.

Separation Agreements and Consent Orders can be prepared subject to the parties agreement after Mediation where Independent Legal Advice (ILA) is mandatory before signing, as both agreements are legally binding.
